Terms and conditions – Saigu Cosmetics

 

PRELIMINARY

These are the Terms and Conditions that regulate the contractual relation of acquisition in regards to the products that Saigu Cosmetics, S.L. offers in its online store.

The Terms and Conditions of purchase described below are exclusively regulated by the contractual relations between any user of the Saigu Cosmetics, S.L., web pages (hereinafter referred to as “the Client”) and the seller, Saigu Cosmetics, S.L. (hereinafter referred to as “SAIGU”, or “us”), owner of the online store: www.saigu.es domiciled in Calle puebla de farnals 50, 46022 Valencia, tax identification number ESB67263533, inscribed in the Barcelona R.M.

 

1. OBJECT

1.1 The object of the present Terms and Conditions of purchase is the supply by Saigu of the products offered through its online store, in exchange for a financial benefit.

 

2. ENACTMENT

2.1. These Terms and Conditions, together with their order confirmation, constitute the contract between Saigu and the Client for the delivery of products. No other Terms and Conditions will be applied.

2.2. The Client will be understood to agree with the general conditions provided in this text from the moment the Client accepts that he/she has read them and agrees with said Terms and Conditions.

 

3. ORDER PLACEMENT

3.1. The Client must carry out the whole purchase process and payment through any system facilitated by the page.

3.2. Once the Client has placed the order, we will send him/her the order number.

3.3. When placing the order, the Client is giving us a purchase offer for the products he/she has selected, in accordance with the present Terms and Conditions. Saigu Cosmetics, SL, can choose whether or not to accept said offer.

3.4. If the order is accepted, the client will be notified of said acceptance through an order confirmation. He/she will be sent a confirmation email, provided that he/she has facilitated an email when filling out the personal data form. If the order cannot be accepted, we will contact the Client through any of the means he/she has facilitated as a contact means for his/her order.

3.5. We will do everything in our power to deliver all products listed in the order confirmation; however, there may be occasions in which such products cannot be delivered, for instance, if said products are not in stock. In such a case, we will contact the Client and perhaps suggest alternative products that he/she may wish to buy instead. If our suggestions are not accepted, the order will be canceled in what concerns the products that cannot be delivered, and the sum of money that was paid for them will be returned. The return of said sums of money will be the limit of our responsibility if we cannot provide the solicited products. On rare occasions, the prices of the products shown in our Online Store may be mistakenly specified, and display a lower price. If this happens, and if we have confirmed the order, we will immediately contact the Client and produce a new order confirmation with the correct price. If the correct price is quite higher, the Client will have the choice to cancel the order, and he/she will be reimbursed.

 

4. PRODUCTS DELIVERY

4.1. We will deliver the products listed in the order confirmation in accordance with the present Terms and Conditions.

 

5. PRODUCTS INFORMATION

5.1. We pay great attention to the information on the essential characteristics of the products, by means of technical descriptions and photos representing the product. Everything is done within the legal framework and respecting the highest standards on the market.

 

6. PRICES

6.1. The price of each product will be clearly stated in the webpage. The price and conditions of the offered products can vary, but, in any case, the price and conditions in force when the Client placed his/her order will apply until such order is delivered.

6.2. We reserve the right to charge the order from the moment it is placed.

6.3. The selling prices shown in our Online Store are shown in the following way:
If the Client lives in Spain, all prices include IVA.

6.4. The service cost for the shipping is not included in the products’ price. The shipping price is the Client’s responsibility and will be added to the total sum of the selected products. The Client will be informed of said cost before confirming the order and completing the purchase.

6.5. We reserve the right to modify our prices at any time. However, we commit to applying the fares indicated on our webpage at the moment the Client placed his/her order.

6.5. During the GreenWeek campaign, starting on November 21st 2022 and ending November 28th 2022, individual products will have a price reduction of 25% and bundles/packs of 30% respectively.

6.6 *Discounts not applicable to Powder highlighter by María Catalá and packs containing Powder highlighter by María Catalá.

 

7. AVAILABILITY

7.1 The Client must consider that orders are sent within the limits of the available stock. If one of the purchased articles is not in stock, we commit to contacting the Client as soon as possible (starting with the date the order was placed) to communicate the time-frame within which the product(s) will be sent. In case the Client is not interested in waiting, he/she can ask for a reimbursement of the price he/she paid for said product(s).

7.2. If any product in the order, after payment, is not available, we commit to sending the available products to the Client and offering shipping fees for free on the rest of the purchase. If possible, we will suggest a product equivalent in quality and price to the unavailable product. If the Client does not accept the proposed substitute, we will reimburse the price of the unavailable product.

 

8. PRODUCTS PAYMENT

8.1. Saigu has associated with Shopify Payments in order to guarantee maximum security for purchases, and, therefore, any operation is 100% protected.

8.2. If our security department suspects anomalies or frauds, Saigu reserves the right to cancel the transaction for security reasons.

8.3. Saigu offers the Client two payment options:

  • Payment with credit/debit card: we accept American Express, Maestro and any Visa or MasterCard registered in the secure payment system Verified by Visa.
  • Paypal.

8.4. If the order was placed by a final consumer or company, the corresponding bill will be produced. In both cases, the corresponding breakdown of IVA (if applicable) and shipping cost will be disclosed.

 

9. PRODUCTS DELIVERY

9.1. The Client will be sent his/her products to the shipping address indicated in the personal data form.

9.2. On the webpage, specifically in the chart, the shipping price is indicated before completing the purchase.

9.3. If the article is indicated as “in stock” when placing the order, the time between the order placement and delivery date will be 2/3 business days from our validation of received payment. If the article is not in stock at the moment the order is placed, we will contact the Client to adequately inform him/her.

9.4. The product will be delivered once the payment has been correctly verified.

9.5. Hours and days are understood as business hours and days, thus excluding Saturdays, Sundays and holidays. If, for any reason attributable to Saigu, such term is exceeded, the Client will be informed and we will propose alternative solutions.

9.6. The Client commits him/herself or a substitute person to be available at the shipping address indicated for the package delivery. In case of being absent the first time, the carrier will try several times. If the product cannot be delivered, it will be returned to us, and the Client will be reimbursed the price of the products with the exception of the shipping and return costs, which will be charged to the Client.

 

10. PRODUCTS WARRANTY

10.1. All products offered by Saigu are under warranty. We commit to replacing the product with a new one, or reimbursing the price, if the product shows a manufacturing defect within 14 days from delivery. In this case, all expenses for the return of the product and shipping of a new one (or the same, repaired product), will be charged to Saigu.

10.2. The customer must inform us of the unconformity of the product within 10 days, through an email in which he/she will state that he/she wishes to return the product. This way, we will adequately organize the refund. In case of the issue displayed by the product not being covered by warranty, the customer will be charged any additional expense generated by the refund.

13. LIABILITIES OF SAIGU AND THE CLIENT

13.1. Saigu commits to providing the Client with all necessary information on the offered products, as well as on orders. Saigu will not be responsible for the non-execution of such conditions in case of force majeure or unforeseeable events, either from the Client or from a third party.

13.2. The Client commits to filling out the order forms, according to the provided instructions. Saig will protect personal data in accordance with current laws. The Client also commits to paying the price of the products, with the corresponding taxes and shipping costs.

13.3. We remind you that a copy of the data of the purchased products should be kept. Saigu is not responsible for any data or archive loss, or for any damage resulting from a failure to produce a security copy of the data contained in the purchased products, proceeding from the Client.

13.4. Saig is not responsible for any consequences that could arise from an inadequate use of the products sold on its Online Store.

 

14. COMMENTS

All opinions written by Clients are checked by the marketing team. If the opinions go against the law, moral or ethics (abusive advertisement, diffamation, insults, out-of-context comments…), Saigu reserves the right to reject opinions.

 

15. PERSONAL DATA PROTECTION

15.1. The personal data facilitated by the Client are essential for the shipping of orders and redaction of bills. The absence of these data will lead to the automatic cancellation of the orders. When signing up in the webpage, the Client commits to providing us with valid personal data, which will allow for the performance of the service, as well as for the correct identification of the registered Client and the mailing of information and advertisement of different products and offers that Saigu may have on its webpage.

 

16. INTELLECTUAL PROPERTY

16.1. All contents of the Saigu Online Store and its Blog (illustrations, denominations, marks, images, videos) are property of Saigu. Any partial or total reproduction of this content through any procedure or any device is subject to previous and explicit authorization by Saigu.

 

17. APPLICABLE LAW AND JURISDICTION

17.1. The present contract will be interpreted and applied according to the current Spanish and European laws.

17.2. The present general conditions are regulated by Spanish law. Stakeholders voluntarily submit to conflict resolution by Spanish law, resigning any other jurisdiction, jury or court from the user’s domicile.

 


18. MODIFICATION OF GENERAL CONDITIONS

Saigu reserves the right to modify, at any time and without prior notice, the presentation and configuration of the webpage, as well as the General Conditions of Use. Clients will always have access to said General Conditions in a visible place, freely accessible for any questions. Clients must carefully read these General Conditions of Use every time they access the webpage. In any case, the acceptance of the General Conditions of Use will be a previous and essential step for contracting any available service through our webpage.
