Terms and Conditions – Loyalty Program

RADIANT CLUB loyalty program

1. Organizer identification

The loyalty program “RADIANT CLUB Loyalty Program” (hereinafter, the “Program”) is organized by:

2. Program purpose

The purpose of the Program is to reward customer loyalty by accumulating points and later redeeming them for benefits, discounts, or other perks.

The RADIANT CLUB Program is free. Participation requires acceptance of these general terms, which you can view, print, or save for your records. Marketing communications will be sent only with your prior consent, and you can unsubscribe at any time via the link available in each email.

3. Participation requirements

The following people may take part in the Program:

Be over 18 years old.
Have an active account on SAIGU’s website, in-store, or app.
Accept these terms.

SAIGU may refuse or cancel the participation of users who breach these terms or the prohibitions in section 5.

4. How the Program works

4.1 Earning points

Users can earn points through the following actions:

Purchases:
- Tier 1 (Clean): 10 points for every euro spent
- Tier 2 (Natural): 12 points for every euro spent
- Tier 3 (Radiant): 15 points for every euro spent
Program registration: 500 points
Newsletter subscription: 200 points
Following on social media: 50 points per action
Birthday: 100 points
First in-app purchase: 150 points
First in-store purchase: 150 points
Shade tests: 50 points per test (one time only per type)

SAIGU may change the actions and the points awarded for business reasons, notifying you on the website and by email. Changes will not affect points already accumulated.

4.2 Tiers

The Program has three tiers:

Tier 1 (Clean): starting tier
Tier 2 (Natural): from 2,000 points earned
Tier 3 (Radiant): from 4,500 points earned

SAIGU may change the requirements to access each tier for business reasons, notifying you on the website and by email.

4.3 Redeeming points

Points can be redeemed for discounts:

1,200 points: 10% off
1,800 points: 15% off
2,400 points: 20% off

Conditions:

Program discount codes cannot be combined with other promotions or discounts currently available on the website.

4.4 Additional rewards

Tier 3 (Radiant) users may receive a birthday gift, subject to:

In-store pickup.
Maximum timeframe of 14 days.
No purchase required.
No home delivery option.
Subject to stock availability.

4.5 Points expiry

Each batch of points expires 12 calendar months from the date it was credited to the user’s account.

4.6 Discount code expiry

Discount codes expire 6 months after they are obtained.

5. Prohibitions

It is expressly prohibited to:

Selling, transferring, or assigning points.
Using the Program for fraudulent purposes.
Creating multiple accounts to gain advantages.

6. Cancellation and suspension

In the event of fraud, abusive use (artificially obtaining points or benefits), or breach of these conditions, SAIGU may suspend or cancel the account and withdraw any points obtained improperly, informing the user of the reason by email.

7. Leaving the Program

In the event of voluntary cancellation or account deletion:

All accumulated points will be forfeited.
The user may register again, starting from scratch.

8. Program changes

SAIGU may modify the Program conditions (points, tiers, rewards, expiry dates, etc.) for justified reasons, such as changes to promotions or business needs, notifying users reasonably in advance via the website and/or email.

If there are changes that affect the redemption value or expiry of points, the user may choose to unsubscribe without affecting their usual consumer rights.

9. Service availability

SAIGU does not guarantee uninterrupted availability of the Program or the absence of technical errors. If accumulated points are lost due to a cause attributable to SAIGU, they will be reinstated.

10. Points value

Points have no monetary value.
They cannot be redeemed for cash.
They are personal and non-transferable.

11. Data Protection

11.1 Data controller

SAIGU COSMETICS, S.L.

11.2 Data processed

The following data may be processed:

Identification: name, email.
Contact: phone number, address.
Personal: date of birth.
Transactional: purchase history.
Technical: IP, web browsing.
Behavior: interaction with emails.
Preferences: results from tests and surveys.

11.3 Purpose

Program management.
Awarding points and rewards.
Sending related communications.

11.4 Legal basis

Contract performance (Program management).
Legitimate interest (Program operational communications, such as point notifications, tier changes, or expirations).
Consent (marketing and commercial communications).

11.5 Communications

The user may receive:

Operational emails (points, rewards, tiers).
Marketing communications (with prior consent).

11.6 Data processors

SAIGU works with third parties such as:

Shopify — Ecommerce platform.
Klaviyo — Email marketing tool.
Tapcart — Loyalty software.
Gorgias — Customer service.

11.7 International transfers

Some providers are located in the United States. Transfers are covered by the EU-U.S. Data Privacy Framework (European Commission Adequacy Decision of July 10, 2023) or, where applicable, by standard contractual clauses.

11.8 User rights

The user may exercise the rights of access, rectification, erasure, objection, restriction of processing, and portability by sending a request to: info@saigucosmetics.com.

If you believe your rights have not been properly addressed, you may file a complaint with the Spanish Data Protection Agency (www.aepd.es).

11.9 Data retention

Personal data will be kept for as long as the user participates in the Program. After cancellation, it will be kept blocked for the legally established limitation period.

12. Cookies

The Program uses cookies and similar technologies. These are managed with prior consent through the cookie management tool implemented on the website.

13. Applicable Law and Dispute Resolution

These terms are governed by Spanish law.

For any dispute, the courts with jurisdiction under applicable law will be the competent ones.

14. Severability

If any clause of these terms is declared null or unenforceable, the remaining clauses will remain in full force and effect.
